The Voice of Colorado’s HomeownersSullan2, Sandgrund, Smith & Perczak, P.C.Denver Construction Defect LawyersSullan2, Sandgrund, Smith & Perczak, P.C. was one of the first law firms willing to take on the Colorado home construction and development industry on a regular basis in the early 1990s. Today we are one of the leading construction defect litigation law firms in the state. We represent homeowner associations and individual homeowners in the Denver Metro area and on Colorado’s Front Range, in the High Country and along the Western Slope in construction defect cases ranging from soil and slope instability problems, to design defects, to poor workmanship, to roadway and infrastructure problems, to building material failures, to insurance coverage disputes. Our firm believes that construction defect lawsuits should be used only as a last resort. We advise homeowner associations and individual home owners to try to work out problems with builders and developers first. If you have exhausted every other reasonable avenue to fix the problem, our law firm can step in and provide assistance. Attorneys Scott Sullan and Ron Sandgrund have authored the only books devoted to Colorado construction defect claims and many leading articles concerning Colorado homeowner rights. For a less technical discussion of the many issues Colorado’s homeowners face, read Frequently Asked Questions. Sullan2, Sandgrund, Smith & Perczak, P.C. has assumed a leading role to protect homeowners’ rights. Its attorneys frequently are asked to testify before the Colorado legislature regarding proposed laws affecting Colorado homeowners and homeowner associations. The firm backs legislation opposing building industry efforts to limit the industry’s liability. Attorney Scott Sullan was selected in 2006 and 2007 as a "Colorado Super Lawyer." In 2007, Mr. Sullan was the only Colorado lawyer who primarily represents homeowners and homeowner associations given Chambers & Partners' highest rating, which legal publisher described him as "the absolute best on residential construction defects." (Read more in his biography under the "Attorney Profile" tab above.) Firm attorneys Scott Sullan, Ron Sandgrund, Curt Sullan and Mari Perczak also have received the highest competence and ethical rating from their peers, "AV," in the Martindale-Hubbell legal directory. The Firm’s attorneys’ published work has been referred to in decisions by Colorado’s appellate courts . The Firm has been profiled by Denver’s major newspapers as leaders in construction defect litigation:
The firm also handles and encourages all forms of alternative dispute resolution in the construction arena, including arbitration and mediation. The firm also has a well-established appeals practice in both the state and federal courts. Homeowner Protection Act of 2007, House Bill 1338: In 2007, firm attorney Scott Sullan met with legislators, citizens and newspaper editors to answer their questions regarding the blanket waiver of legal rights that much of the residential building industry has been putting in home purchase contracts. House Bill 1338 limits such waivers and preserves for homeowners the basic, legal rights the building industry agreed to when it lobbied for passage of the Construction Defect Action Reform Act in 2003. H.B. 1338 was adopted and became effective April 20, 2007.
